Ex-recruitment bosses disqualified following failure to pay tax

The two former directors of a liquidated Walsall recruitment company have each been given three-and-a-half year bans from being company directors after an investigation from the Insolvency Service found they previously paid no tax during the operation of the now-liquidated company.

Scott Alan McKenzie and Anna Michelle McKenzie officially launched sales and marketing recruiter The McKenzie Partnership in April 2007, and it ceased trading in July 2010, with an Insolvency Service investigation finding no tax paid in this time. During this time £119k was paid to the two directors in total.Both directors will be barred from being able to “act as a director of a company; take part, directly or indirectly, in the promotion, formation or management of a company; be a liquidator or administrator of a company; or be a receiver or manager of a company’s property”, effective from 8 November 2012, according to an Insolvency Service press statement.

Given the opportunity to respond by Recruiter, Anna McKenzie says: “The failure of this historic business [The McKenzie Partnership] is attributable in large part to the timing of its launch which coincided with the economic downturn of 2008 and the damaging effect this had on the recruitment industry generally.”

She also says that the Insolvency Service undertakings “were provided with our full co-operation and consent”.

Both she and Scott McKenzie are currently listed on the website of Walsall-based Nexus Sales and Marketing Recruitment as directors of the firm, although only Anna McKenzie is listed as a director on Companies House. She is the only listed director of the firm, which incorporated in November 2009.

“Whilst there were grounds to challenge, we preferred to take a pragmatic view, avoid the uncertainties of litigation and instead continue to build our Nexus Partnership brand which has been operating successfully and in compliance with all HMRC and Companies House requirements for the last three years”, she adds.

Commenting on the disqualifications, Claire Entwistle, director of company investigations for the North at the Insolvency Service, said: “The undertakings signed by Scott Alan McKenzie and Anna Michelle McKenzie send a clear message to other company directors; if you run a business in a way that is detrimental to either its customers or its creditors you could be investigated by the Insolvency Service and as a result removed from the business environment.”
