Nick Hurley, a partner in the recruitment sector group at law firm Charles Russell, told Recruiter that any changes to the legislation would now require additional amending legislation.

The AWD is set to come into force on 1 October 2011.

“It is quite a long period of time until October 2011, and this will give agencies and hirers sufficient time to adjust and make the appropriate changes,” adds Hurley.

Last week the Association of Recruitment Consultants said it was awaiting a response from BIS (Department for Business Innovation and Skills) to its claims that part of the draft regulations may not be legal.
