The continuing uncertainty about the debt transfer provisions of the Managed Service Companies (MSC) legislation is resulting in agencies "asking contractors masses of questions, most of them needless and irrelevant."
John Kell, policy officer at the Professional Contractors Group, told Recruiter that the fear that agencies might potentially be liable for the unpaid tax and national insurance of contractors had lead to some agencies sending out questionnaires requesting up to "47 pieces of separate information" to ascertain that contractors were not MSCs.
Kell said: "Agencies only needed to ask one or maybe two questions. Is there a scheme provider involved with your company as per the MSC legislation?"
