A complex case involving the sale of a £70,000 racehorse through an agent raised some pertinent issues for purchasers, as Alan Ma explains

It is not uncommon that buyers, as principals, employ agents to negotiate and conclude contracts on their behalf. But sometimes the identity of the buyers is not disclosed. When an agent incorrectly claims to be authorised to enter into a contract and the seller relies on that warranty, the seller can sue the agent for damages for breach of warranty of authority.
