Companies can guard against having to pay suppliers below them in a chain before they are paid themselves by putting ‘pay-when-paid’ clauses in contracts. Daniel Atkinson explains
Commercial projects frequently involve many contractors, subcontractors and suppliers. Payment difficulties at any point along the contractual chain can create problems for those in the middle. The risk is that a firm may have to pay those below it in the chain when it has not been paid itself.
