To ensure the dismissal is fair, you need to prove that you had a valid reason for dismissing the employee. All options must be sought to resolve the issue beforehand. There are a number of areas where you can legally dismiss an employee, providing you have followed the correct procedures. These include redundancy, capability, conduct and statutory requirements.
