What does ‘equal treatment’ mean to you? The government has opened the first stage of consultation in defining the details of how the European Agency Workers Directive will be implemented in the UK. The issue of equal treatment is critical because how that term is defined will ultimately determine the financial and legal consequences of the AWD on the UK’s recruiters and employers. If temporary staffing is part of your business, the Directive will affect you. And with the launch of consultation, you have the opportunity to give your opinion to the government now. Input is being sought specifically on the definitions of pay, holiday entitlement, duration of working time, the 12 weeks qualifying period, how the principle of ‘equal treatment’ should be established, liability for compliance with obligations under the AWD and dispute resolution.
